Which contracts have a 3 day right of rescission?

 

By law, the only contracts that have a 3 day right of rescission are contract solicited by door to door sales and telephone sales.

Bill: Yes, I had someone come to my house and gave me a quote for a full enclosure. I signed the contract at that time, but I didn't want to go with them because someone else gave me a better price. I signed the contract, I had to go with that. But someone was telling me that they didn't-- in their contract there is no any right to that three days’ notice to reset contract. Do I have go report on full enclosure has been billed?

Attorney Tom Olsen: Well the answer is no Bill. A lot of people think you sign a contract in Florida you automatically get a three day right of rescission. Not true. There are always certain circumstances where the law requires that there be a three day right of recession. One is for telephone solicitation, the other is for door to door sales. When you are in a situation where the law requires that there be a three days right recession the law also requires that the three day right recession be in your contract in big bold letters. Bill no, you don't have a three days right of recession whether or not you could actually get out of that contract or not. Maybe there's some kind of loophole in there but I would not know without actually looking at the contract.

Bill: But even though they came to my house and made the sales that doesn't qualify?
