Does your out of state trust need to be redone when you move to Florida?

 

Your out-of-state trust will be fine in Florida, but you may need to redo the accompanying documents like powers of attorney and living will.

The first one is, they have a living trust from Michigan, they now live in Florida, the question is, do they need to redo their living trust from Michigan? The answer is no. The living trust that you did in Michigan is going to work perfectly fine here in Florida. Remember, when you do a trust there are related documents like health care, powers of attorney, living trust, living wills where you ask that you not be kept alive by machines, those documents are specific to Florida law. Even though your Michigan living trust may be working fine here in Florida, you may need to redo the related documents.
