Attorney Tom Olsen: Tell you about a client I had last week. He was a medical doctor, and he's had a long time practice here in the state in Orlando. He's had a office administrator that's been with him for over 20 years. He credited her with a large part of his financial success and operating this office. As you might imagine, we've got some people around here like that as well. He had accumulated quite a large 401(k). To reward her for that, he wanted her to have a part of that 401(k). Before he came to see me a year ago, he did a homemade will. In that will, he says, "I want her to get 30% of my 401(k)," thinking that would be just fine, no problems there.
Of course, what I told him was is, "Hey, what happens? Your 401(k) is not governed by your will. It's governed by how you filled out your beneficiary designation form with the 401(k) administrator." He was completely surprised. He got it, but he just, "I never thought about that, Tom."
