Living trust problems
In order to avoid probate, your trust must own your assets.
Attorney Chris Merrill: Is it correct that the only way I can avoid probate on my home is to have a trust?

We got a simpler tool for that, the lady bird deed, and we have a great booklet on that, but let's say this Chrissy, that a lot of people over the years, they've gone to an attorney, they spoke these words, "I want to avoid probate." The attorney put them in a trust. They paid thousands of dollars for it and guess what? The attorney did not put their home in the trust. Therefore, even though they spent money on his expensive living trust, their home is still going through probate. The lesson we learn there folks is a lot of people out there have living trusts, but their homes, their trust don't own their homes therefore their homes are still going through probate.
