How do you protect rental property from Medicaid and nursing homes in Florida.
Attorney Tom Olsen: Robert, most people own their homes. We know that when they're talking about going to a nursing home, but what happens when people have a rental property or a vacation condo at the beach? How do you protect something like that from nursing homes and Medicaid?
Attorney Robert Hidock: For a rental property, that would be excluded if it is income-producing, meaning the asset remains safe and protected as non-countable. The income, however, that could be subject to having to go pay for the skilled nursing home as computed as part of income, but the asset itself becomes protected.
